CRÉDITO PRESUMIDO - ALTERAÇÕES

RESUMO: O presente Decreto altera disposições relativas à concessão de crédito presumido do ICMS nas remessas de veículos automotores, inclusive para ativo fixo, destinadas a contribuintes deste Estado, para efeito da cobrança do ICMS, devido por substituição tributária.

Altera disposições relativas à concessão de crédito presumido do ICMS nas remessas de veículos automotores, inclusive para ativo fixo, destinadas a contribuintes deste Estado, para efeito da cobrança do ICMS devido por substituição tributária.

A GOVERNADORA DO ESTADO DO RIO GRANDE DO NORTE, no uso das atribuições que lhe confere o art. 64, inciso V da Constituição Estadual,

DECRETA:

Art. 1º - Passa a vigorar com a seguinte redação o art. 112 do Regulamento do Imposto sobre Operações Relativas à Circulação de Mercadorias e sobre Prestações de Serviços de Transporte Interestadual, Intermunicipal e de Comunicação (ICMS), aprovado pelo Decreto nº 13.640, de 13 de novembro de 1997:

"Art. 112 - ...

XVII - até 30.06.2003, nas remessas dos veículos automotores relacionados no Anexo 115 do Regulamento do ICMS, inclusive para ativo fixo, destinadas a contribuintes deste Estado, para efeito da cobrança do ICMS devido por substituição tributária, nos seguintes percentuais, observado o disposto nos §§ 14, 15 e 16:

§ 16 - Condiciona-se a fruição do benefício disposto no inciso XVII à adoção do regime de substituição tributária.

"Art. 885 - Nas operações interna, interestadual e de importação com veículos novos classificados na NCM (Nomenclatura Comum do Mercosul) relacionados no Anexo 115 do Regulamento do ICMS, fica atribuída ao estabelecimento industrial fabricante e ao estabelecimento importador a responsabilidade pela retenção e recolhimento do ICMS, devido na saída subseqüente ou à entrada com destino ao ativo permanente.

Art. 2º - Fica acrescentado o Anexo 115 ao Regulamento do ICMS, aprovado pelo Decreto nº 13.640/97, conforme modelo constante no Anexo único deste Decreto.

Art. 3º - Fica revogado o Decreto nº 15.976, de 27 de março de 2002.

Art. 4º - Este Decreto entra em vigor na data de sua publicação.
